Terms of Service

1. Service Description

BoomSauce, Inc. ("BoomSauce," "we," "us") provides an email marketing and lead acquisition platform ("the Service") accessible at app.boomsauce.com. The Service enables users to discover business contacts, build email campaigns, and track engagement.

2. Account Registration

You must sign in using Google OAuth to create an account. You are responsible for maintaining the security of your Google account credentials. You must provide accurate information and promptly update it if it changes.

3. Acceptable Use

When using BoomSauce, you agree to:

  • Comply with the CAN-SPAM Act, GDPR, and all applicable email marketing regulations
  • Only send emails to recipients who have a legitimate basis for contact
  • Include accurate sender information and a functioning unsubscribe mechanism in all campaigns
  • Not send unsolicited bulk email (spam)
  • Not use the Service to distribute malware, phishing attempts, or illegal content
  • Not attempt to circumvent rate limits, abuse detection, or security measures
  • Not resell, sublicense, or redistribute access to the Service without authorization

4. Usage Limits

The Service includes usage limits based on your subscription plan tier, including but not limited to: number of contacts, emails sent per month, lead searches, connected mailboxes, and campaign volume. We reserve the right to adjust these limits at any time. Current limits are displayed within your account dashboard.

5. Pricing and Payment

We may offer free and paid subscription tiers. Pricing, features, and limits may be adjusted at any time with reasonable notice. Changes to pricing will not apply retroactively to the current billing period.

6. Data Ownership

You retain ownership of all content, contacts, and data you upload to BoomSauce. We claim no intellectual property rights over your content. You grant us a limited license to process your data solely to operate and improve the Service.

7. Account Suspension and Termination

We may suspend or terminate your account if you violate these Terms, engage in abusive sending practices, fail to pay for a paid plan, or if required by law. You may terminate your account at any time through in-app support. Upon termination, we will delete your data within 30 days unless legally required to retain it.

8. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, BOOMSAUCE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, OR BUSINESS OPPORTUNITIES, ARISING FROM YOUR USE OF THE SERVICE. OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE TWELVE MONTHS PRECEDING THE CLAIM.

9. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT GUARANTEE THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE.

10. Indemnification

You agree to indemnify and hold harmless BoomSauce, Inc. and its officers, directors, and employees from any claims, damages, or expenses arising from your use of the Service, your violation of these Terms, or your violation of any applicable law or regulation.

11. Changes to Terms

We reserve the right to modify these Terms at any time. Material changes will be communicated through the platform. Continued use of the Service after changes take effect constitutes acceptance of the updated Terms.

12. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Florida, without regard to conflict of law principles. Any disputes arising under these Terms shall be resolved in the courts located in the State of Florida.
